Inner Journeys

An inner journey can be described as the exploration of ones self, as individuals review their growth and development in the light of experiences which challenge and inspire them. Big Daddy

The film directed by Dennis Dugan, ‘Big Daddy’ made for the entire family, is a journey about self-discovery undertaken by a man named Sonny, when one day a child named Julian arrives at the front door, Julian represents the innocence and sincerity that slowly affects Sonny and his outlook on what life is about. Julian shows Sonny that there is more to life than sitting around ‘goofing’ off and working one day a week. Sonny acts like a mischievous child, and the world is his playground, when he is all of a sudden left with a child and has to grow up and act his age, he takes on all the responsibilities of a parent, hence the name ‘Big Daddy’. Sonny is reliant on his girlfriend Vanessa to help him raise Julian, but a sudden turn of events leave Sonny with a child, which he believes is out of his control and should belong with someone better at raising kids than he is a common problem with first time parents. Eventually, with some influence from Sonny’s father, Sonny gives up the parental responsibilities, and lets Julian run his own life, “I’m creating a new style of child raising, give the child options not orders…” Sonny didn’t want to be a ‘prick’ like his father was. Sonny eventually meets Leila, she is represented as the motherly figure, and she too influences Sonny, to change his way of life. Gradually, Sonny realizes that there is more to life and he decides to start a new family, get a decent job, and uses his experiences with Julian to raise his own family.

Journey up

The poem ‘Journey up’, is written for basically anyone and is one about life and choices one has to make. The opening phrase “The journey up to where you want to go is not a straight line” is saying that life is not easy and straight forward as one would hope to be, that it is quite the opposite. The steps are a metaphor, for different times in our life where the choices we make are like imaginative steps taking us further. The ceiling cobwebs are also a metaphor for life problems that can occur, and that it happens to everyone, this poem is giving valuable life advice to the responder, and that life is “uneven, rough and steep, but will eventually take you where you need to go.”

Dr Faustus

The play by Christopher Marlowe, The Tragic History of the Life and Death of Doctor Faustus, or Dr. Faustus, is about the Inner Journey that Faustus was trying to achieve, he wanted to have endless knowledge but when he achieved that he wanted more, he wanted to be better than god be on earth as Jove is in the sky. he started off as just wanting endless knowledge but then his greed over powered him and he gave in to Mephistopheles and sold his soul for the endless knowledge, this is relevant to the Elizabethan audience because the play was written at a time when everyone was moving away from the belief in the catholic church and what they will be rewarded with in heaven and moving towards what they can achieve on earth here and now. The Elizabethan audience relate to Faustus in this way but they differ from him in the way that they did not have the drive to actually do what Faustus did and sell his soul for what they want, this elevates Faustus from the Elizabethan audience but it is still dramatically effective for them as they want answers for what Faustus gets answers for. When he received his 4 years of knowledge he wanted more and he travels through the sky on dragons, then he travels to places, then to individual towns and finally to individual people like the pope - this is when he visits the pope invisibly to annoy him - this shows the pettiness of Faustus knowledge and power. In the end Faustus becomes really greedy as he regrets selling his soul and wants it back. Faustus here is related to Icarus in the way that Icarus wanted to fly to the sun - he made his wings of wax and flew but when he was flying he realized he wanted more than just to fly - he wanted to fly to the sun and he did - the wax wings melted and he fell to his death. This is similar to the downfall of Faustus as he too was over-reaching by selling his soul to gain his endless knowledge which turned out to be limited and he too fell to his death.

These composers show that Inner Journeys can be undertaken by anyone, and is normally done to better understand ones self. However, as seen in Dr. Faustus that ones own desires can be the downfall of ones self. One may think that an inner journey can be undertaken by themselves however, it may take more that one person to better understand ones self. Dada and Surrealism

During the days of World War I, a search began for new and fantastic subject matter, and so this brought together a number of young men. The writer, Hugo Ball, the painter, sculptor and poet, Jean Arp and the painter Hans Richter, as well as many others, all began this search of new and exciting styles that brought on the movement called Dada. This movement was largely a reaction to the destruction, hysteria and madness of the war. The Dadaists felt that reason and logic had resulted in war, and so, they wanted to move away from this and explore different principals such as simultaneity and chance.

There were two main parts to Dada, Zurich Dada and New York Dada. Zurich Dada came about as a result of these men whose demonstrations, art exhibitions, poetry readings and noise concerts attacked Western Art and Culture. Jean Arp was one of the most prolific artists to emerge from Zurich Dada. He studied painting in the early years of the twentieth century but found that there was great conflict between his paintings and what he learnt. This uncertainty that he had, led him to spend years in various small towns in Switzerland where he was greatly influenced by the Swiss landscape. This resulted in many abstract works that were all based on nature and living organic shapes. He wanted to express the reality of the object itself in the most concrete terms as possible; hence he used a form of organic abstraction. This led him from painting to collage and then to relief and sculpture in the round.

A typical work is “Collage with Squares Arranged according to the Law of Chance.”

This work is a collage of torn squares of paper arranged in a random order. He produced many works in this vein and it is said that they were a result of his tearing up drawings with which he was not satisfied and, seeing the arrangement the papers made on the floor, he realized he had found the solution to his problem. It was actions such as this that showed Arp’s interest in “the laws of chance.”

Although Zurich dada had finished by the end of World War I, its influences were just beginning to spread, and it was then that New York Dada emerged. It began with the artists Marcel Duchamp and Francis Picabia arriving in New York and sharing similar ideals. Duchamp was disillusioned by the validity of art. He was influenced by Cubism, as is evident in his paintings, but he didn’t like the more formal ordered direction that it was taking. Another distinct influence was that of the futurists. Not on Duchamp alone but on the Dadaists in general. Although Duchamp used a lot of the Futurist principals, such as devices with the feel of machinery, his Dadaist art was an expression of disillusionment, whereas the Futurists’ art was much more optimistic. Duchamp’s works were often satirical especially when he attempted to re-interpret traditional themes however all of his works take on a brilliant construction of abstract forms. His works include, “The Passage from Virgin to Bride,” and “The Bride Stripped Bare of her Bachelors, Even (The Large Glass).”

Duchamp was also the initiator of “ready-mades.” These were objects or paintings that were complete on their own, that Duchamp would just add to. A good example of this is “L.H.O.O.Q”. Here, he has taken a copy of the “Mona Lisa” and added a beard and moustache to it, and called it a work of art. Another example of a ready-made is a work entitled “Fountain” which is quite simply a urinal on which he has signed “R. Mutt.” Needless to say this caused a great stir when he tried to exhibit it in 117.

Duchamp was in some way trapped He wanted to destroy facets of art altogether, but his Dada works contained elements of his art that he truly hated. However, his primary motive was to show that he rejected the ideas and idols of society. This influenced the “tone” of his paintings in a number of ways. His willingness to use just anything as art, especially the ready-mades brought up the question, “What is Art?” and this is exactly what the Dadaists wanted. However, Dada wasn’t all wild, mad humor aimed at annoying the middle class man. It had a purpose that of re-examining and exposing the conceptions of order and beauty.

Surrealism however, deals with a different kind of reality, a super-reality that exists in our subconscious. The surrealists believed that the reality of dreams was superior to that of waking reality. They were not influenced as much as the Dadaists were by war but by the theories of Sigmund Freud. Up until then, the subconscious was still undefined and they wanted to expand and explore themes involving the subconscious aspects of life.

One of the characteristics of Surrealism was an element of chance, just as was used by the Dadaists. Accidental blots, textures and signs were incorporated into paintings to add to the effect that they wanted to create; where no attempt would be made to define the works or make them understandable. Surrealism has been defined as “the state of mind where there is no difference between the past and the present, between life and death, high and low, real and unreal.” This is exactly what the Surrealists tried to portray even though all the surrealist styles were very different.

The chief Surrealists were Max Ernst, Miro, Magritte and Dali and although their styles were all very different they all had common aspects such as a vision of totally new subject matter and individuality and isolation as artists. Much like the Dadaists they wanted to explore something new and completely different. They also propagated revolt against society and tradition just as the Dadaists did and their works, and also created great controversy because of the subject matter involved.

Salvador Dali epitomizes the Surrealist artist, not only in his art, but also in his lifestyle. He was greatly influenced be De Chirico, Carra and by the writings of Sigmund Freud, and moved to Paris in 1 to join the Surrealists.

Dali tried to recreate his dream world and attempted to make it more real than everyday, accepted reality. His paintings were extremely precise, in complete contrast to many of the Dadaist works in the way that they were almost photographic, as can be seen in his “Basket of Bread.” His works are often very contradictory where mechanical objects are soft or organic. Objects often disintegrate, melt and metamorphosis. An example of this is “The Persistence of Memory” where there are several melting clocks and foreign objects. There are many dissolving and transforming images in his works. Images are doubled, juxtaposed and repeated constantly, however, his paintings were painted in a very realistic style with very fine brushwork with a very gentle and delicate use of colour. He stuck with a very realistic technique instead of painting in the ways of the Cubists and Impressionists. The Dadaists, however, were influenced by the Cubists, as can be seen in many of Duchamp’s works. In his works there is traditional use of line that is neither abstract nor decorative which is, however, seen in Dadaist works. His paintings often have eerie, haunting allegories and phobias often that populate his work.

Another Surrealist artist is Max Ernst. Ernst’s paintings often include machine monsters that show the Dadaists preoccupation with mechanization and automatism. His interest in metamorphosis and double identity of objects led him onto Surrealism and he began painting in a new style that still dealt with realism but in a fantastical way, just like Dali. Ernst’s painting also dealt with Nightmares, dreams and the subconscious with fantastic creatures such as elephants, as seen in “The Elephant Celebes.” His works also include many birds and dream landscapes as seen in “Two Children are Threatened by a Nightingale.” He is said to have created the “surrealist vocabulary” and unlike some of the Dadaist works, they are never totally abstract.

Both Dadaism and Surrealism were extremely dynamic and interesting movements. They rebelled against the conformities of society, began to explore completely different subject matter and although were different in many ways, they were the start to a completely new outlook on art and culture of the 0th century.

America in Horror

Tuesday September 11,001, was supposed to be a normal day as usual in New York City (A city that never sleeps). Kids going to school and other going to work etc. All of a sudden America got a wake up call. New York was under attacked by two hijacked commercial airliners that collided and crashed in the two World Trades Centre buildings killing over thousand of people including passengers in the plane when both twin towers collapses to rubble. It was terrifying watching people jumped out the window to their death, crying for help and watching them died in agony. “America will never be the same.”

Later that day there was another attacked about to take place in Washington D.C when a third commercial airliner ran into the Pentagon building. There were about eight hundred people in that building. The officials reported that hundreds are dead including passengers in the flight and some are unaccounted for. A forth plane supposedly targeted to collide onto the Whitehouse instead the plane crashed in Pennsylvania. There weren’t any survivors in that plane.

We don’t understand why these Hijackers (Terrorist) had done such as thing, killing themselves and killing innocent victims. Are they mad? Did they do this for revenge? For their faith or they instructed by head terrorist Bin Laden.

Watching this terrifying tragedy on the news is like watching a movie, but this was real. Planes crashing into the buildings, victims losing their love one, real life hero such as firefighter and police officers risked their own lives to save people inside the building. It was a bit too late to rescue people in the twin towers when the towers collapse unexpectedly, trapping people with the rescuers. No one knows if there are still people trapped alive. In the past days, officials like firefighters, police officers and volunteers helped one other in searched for missing people.

It was a difficult week in the Untied States and Nation Wide. Last Tuesday’s cowardly attacked by the terrorists who killed thousands of innocent men, women and children. The victims will never be forgotten and forgiven. I can pray for the families who lose their love ones in this tragedy.

I believed these terrorist hijackers did this barbaric act for their faith. I didn’t believed any type of God will slaughter innocent human beings for any reason.

I agreed with the President of the United States George W. Bush who encourage us to go back to our normal lives soon as possible and go on with our everyday lives.

God bless America. I will pray for those who lose their lives in this tragedy and hopefully this were not be the beginning of World War .

in 187. His second book was named The Alchemist and was published in 188. This book has

gone to number one in countries and Coelho has been regarded as the most widely read

contemporary writers. The Alchemist was one of the top ten international best sellers of

18. His work has been published in more than 100 countries and is translated into

different languages. He has been awarded a variety of prestigious awards from many different

countries. He today lives in South America with his family. Main Characters - The Shepherd -

This was the boy through whose eyes the story was told. He followed his personal legend to

the fullest and never let up with his dream. He went all over the land and was able to realize

the treasure that he had been so close to in the beginning of the novel. The King - He was the

one that gave the shepherd the two stones that would supposedly help him whenever he had a

rough time deciding about what to do. He made the boy give him ten percent of his flock,

because you should never promise something that you dont have. The Englishmen - This was the man that the boy met on his trip to the pyramids. He was the one who turned the boy onto the idea of the alchemist and the masterwork. Before this he had never known of the alchemist and the great things that he could do in the world. The Alchemist - This is the man that he met in the desert and he helped the shepherd to lead the people from the danger that was imminent from the war. He also allowed the boy to follow his legend and realize his dream. Summary - The story begins when the shepherd boy stopped for the night in a church with a sycamore tree growing out of the middle. He told of the easy going life of the shepherd and how his parents had wanted to become a priest. He had attended all of the schooling, but had decided against it at the last minute. He had wanted to see the world and he felt that the best way to do this was to go and become a shepherd. He said that the life of a shepherd is easy and carefree and he felt like that this was the way that he wanted to spend his life. He was anticipating

seeing the daughter of a man who would buy the wool from his sheep when he arrived in the

town that he would come to in another couple of days. He thought that he might actually

settle down and get married to this girl if she would like to. He had been having a recurring

dream about him at the pyramids in Egypt. There he would be able to find all of the treasure

in the world and to realize what would come to be called his personal legend. So, the next

town that he went to he went to a fortuneteller and asked her if she could help him out of his

dilemma. She was unclear about what to do, but she made him promise to give him a percentage of

his treasure if he ever found it. When he left the fortuneteller, he went and sat in the park

where he would have been content to read his new book. He was not in a good mood for talking

with others when the old king approached him and tried to strike up a conversation with him.

Africa. There he was setting off with all of his money in his pocket and set to a bar where he

didnt speak the same language as any of the people there. He was taken for a fool and all of

his money was taken in the first few hours. He stayed in the town for a while and he went into

a shop that sold crystal. He helped the man to clean all of the crystal and while he was there,

two people came in and bought crystal. The owner thought that this was a good omen and that he

should try to keep the boy around. Since he didnt have any money he stayed on for eleven months

and greatly improved the mans shop. When he finally left he had enough money to do with what he

wanted and he set off to fulfill his personal legend. He traveled to the pyramids by way of

northern Africa. About half way through his trip he came onto an oasis that was in the middle

of a war between two native tribes. The rules of war said that the oasis should be a safe

haven for all of the people that were traveling through the desert. This is where he met the

alchemist, the man that would help him to realize his personal legend. By going off into

desert at night, he learned all about the masterwork and the many things that he needed to do

in order to become a true alchemist. He began to have a dream about a group of rebels attacking

the oasis because they thought that the travelers would be taking up arms against them. The boy

went to the men who were in charge of the oasis and told them of the impending doom that was

coming onto the oasis. They didnt believe that this dream was an omen but they gave him one

shot. The rebels did attack and they were able to fend off all of the assailants. The boy was

hailed as a hero and he went off into the desert to seek his personal legend. Here he was

forced to make a decision about whether or not to leave behind the woman that he had met and

had decided to marry. He said that he would return later and he did. This was after he found

out about his treasure that he wanted for such a long time. He finally figured out that his

treasure was in the sycamore tree that was growing out of the middle of an old church. He

returned to his homeland and had his treasure intact and was able to live happily ever after.

Theme - The main theme of this novel was that you should follow your personal legend to the

fullest. Throughout his life the boy had been discouraged and could have given up on his dream.

But, this would have caused a void in his life. This is sort of like the old man who owned the

crystal shop, who would not take a pilgrimage because he would have nothing left to look forward

to in his life. When the boy was leaving though, he did decide to take the pilgrimage and

probably did not regret the fact that he had done something to prove his faith. The Boy faced

many obstacles in his lifetime but stayed true to what the omens had told him and also what his

personal legend had been. In the end he realized the legend and found what he thought to be

true happiness. Analysis - The thing that particularly annoyed me about this book was the fact

that was that the theme was ever changing. Within the main theme there were many other small

themes that helped to develop the main theme, but added to the confusion of the novel. The

thing that I liked about this book was that it was very straightforward and left nothing up to

the imagination. If I were to rewrite this book I would change it by adding in a little more

bad things that happen to the main character to show the real hardships that he had faced while

chasing his personal legend. If I would have had the opportunity to speak to the boy in the

book I would have told him that he should have stayed on at the crystal shop because he had a

good thing going and he could have made a lot of money and bought his own happiness and

realized his personal legend in his own rite. One thing that reminded me of another book that

I read was In the Lake of the Woods, because both of the main characters were trying to run

away from what had been in their lives to find something better. I would recommend this book

to anyone who was undecided about what their life was meaning to them. This book really gives

them insight about their lives and that someone is worried about them and that there is

something that they have to look forward to, like the crystal merchant.

Duke Vincentio plays a very important, yet controversial role in William Shakespeare’s Measure for Measure. Firstly he gives power away to Angelo his deputy, and disappears from the Viennese political scene, to come back as an advice-giving Friar. He then goes on to try to resolve the situation between Isabella and Angelo. Angelo his replacement at the head of power gives Isabella an ultimatum involving the life of her dear brother Claudio. Isabella has to sleep with Claudio in order for her brother not to be executed, so Isabella comes to Duke Vincentio (disguised as Friar Lodewick) for help.

The Duke in Act , scene we first see the Duke disguised as Friar Lodewick and he seems very helpful, caring and virtuous which of course are the traits that made him the Duke he was. The Duke’s action seem to be very unselfious, he gives up his power because he feels he is not fulfilling his duty and goes out of his way to help the grieving Juliet. Then the Duke meets Isabella and falls for her beauty he even goes as far as saying that ‘the hand that has made you fair hath made you good’. This influences his actions for the rest of the play, as he now seeks to make Isabella his own and make sure she stays away from Angelo. He then makes sure that Isabella switches with Mariana, who was betrothed to Angelo, and that she goes to sleep with Angelo instead of Isabella. He then switches Claudio with Barnadine and he is executed instead of Claudio.

The Duke’s actions remain constant as they help other people out, and he pushes for a joyous resolution. But of course the actions that he commits for him only have two final destinations. Firstly he wishes to become Duke again, and wants the Viennese to see just how virtuous and inspiring a leader that he can be. His actions more than suggest that he is trying to push Angelo away from power. Secondly his actions proof that he is madly in love with the fair and enchanting Isabella. He would not risk the life of Mariana by sending her to Angelo instead of Isabella, and execute Barnadine to make to Isabella happy if he was not doing everything for her. Therefore we can also say that his actions are not always constant as he switches the aim of his actions. His actions can be seen as acts of love, or as acts of trickery on Angelo.

The actions that he takes cannot entirely be seen as responsible. The only types of responsibility that he used in his actions are the ones that he has to accept the full responsibility for. His actions cannot fully be justified as being responsible or even reasonable; after all he is blinded by his love for Isabella. He tampers with the emotions of Mariana and Angelo by re-uniting them after their traumatic separation due to the unfortunate drowning of Mariana’s brother. The execution of Barnadine on the other hand can be seen as responsible although many would beg to differ. Barnadine was already waiting to be executed a long time and he had commited a crime under the Duke’s reign. Claudio commited a crime that was hyprocritcally condemned by Angelo, so Claudio had a viable reason not to be executed.

The last speech made by the Duke in the play sums up all of his actions and the reader has to make his own judgement on whether or not the Duke’s actions were consistent and responsible. Age Discrimination in Employment Act

Congress enacted the Age Discrimination in Employment Act (ADEA) in 167 (Bennett-Alexander, 6). Even though the Act was passed more than thirty years ago, age discrimination still exists today. Although some of the cases of age discrimination may not be intentional, many are. Whatever the reason for the discrimination, intentional or unintentional, it still violates the ADEA. For this reason, it is important for employers to understand the ADEA and ways in which they can prevent being sued for age discrimination.

The Law

The ADEA states

Sec. 4 (a) It shall be unlawful for an employer-

(1) to fail or refuse to hire or to discharge any individual or otherwise discriminate against any individual with respect to his compensation, terms, conditions, or privilege of employment, because of such individual’s age;

() to limit, segregate, or classify his employees in any way which would deprive or tend to deprive any individual of employment opportunities or otherwise adversely affect his status as an employee, because of such individual’s age; or

() to reduce the wage rate of any employee in order to comply with this chapter (Age Discrimination in, ).

The reason the ADEA was enacted was to force employers to evaluate employees, or prospective employees, on their skills and abilities, rather than on their age. There are a lot of assumptions about older workers, that may or may not be true, but which cannot be used in the hiring, firing, training, or evaluation process. One such assumption is that as employers get older, they can no longer adapt to changes in the business. Another is the assumption that older people cannot perform job tasks as well as somebody younger. Yet another assumption is that it is a waste of time and money to train an older employee because they will be retiring soon anyway. These assumptions are several of the reasons that forced Congress to enact the ADEA.

An employee, or prospective employee, may feel that he/she has been discriminated against because of age, but that does not mean that they will automatically win a lawsuit. There are two types of ADEA claims, disparate treatment and disparate impact. Disparate treatment claims arise when an individual alleges that their employer, or prospective employer, discriminated against them because of their age. In order for an employee to persuade the court that they have a true case of age discrimination based on disparate

treatment, they must first present a Prima Facie Case. They must prove the following four elements

1. That he/she is 40 years old or older.

. That he/she was adversely affected by the decision of the employer.

. That he/she was qualified for the position.

4. That he/she was treated differently than those who are younger (Bennett-Alexander, 7).

Unlike disparate treatment claims, disparate impact claims are based on the results of an employment practice. On its face, the employment practice is neutral, but in reality it has a disparate impact on the protected class. These cases are neither overtly or covertly based on the protected characteristics, but have an unjustified effect on the protected group. It is important to remember that just because the discrimination was not intentional does not mean the employer will not be held legally responsible (Bass, 0).

Until recently, the Age Discrimination in Employment Act covered only United States companies with more than 0 employees, or foreign companies with more than 0 employees in the United States. In March of 18, a federal appeals panel in Manhattan declared that the law covers all foreign companies conducting business in the United States with more than 0 employees total, not just 0 employees in the United States. The judged backed his decision by stating that there is not language in the ADEA requiring foreign employees to be excluded when determining which companies satisfy the 0-employee minimum. In the ruling, the judge also ruled that domestic employees of foreign companies are also protected by the ADEA (Pines).

Anti-ADEA

Some believe that the ADEA is unfair. They think that some companies have good reason for firing older employees, even if the main reason is age. They are also disgusted with the fact that the Supreme Court has yet to set down specific guidelines as to when it is okay and not okay to fire based on economic reasoning (Seligman, 116-118).

There is one instance mentioned where a Supreme Court judge, Chief Justice William H. Rehnquist, makes inappropriate remarks regarding age. He is quoted as saying “It was what you might call stereotypes about going downhill after a certain age, which...a lot of us can testify to [Laughter]” (Seligman, 116-117). This judge also said that there was no invidious discrimination in laws classifying people by age. The way in which these remarks are interpreted casts a dark shadow on the case for the ADEA. Many take his remarks to mean that older workers have never experienced the purposeful unequal treatment of other protected classes such as racial and religious minorities. Anti-ADEA groups interpret Rehnquist’s remarks to mean that discrimination against older workers is not a big deal because almost all of us will get old someday (Seligman, 117).

The group of people that are against the ADEA feel that age discrimination is quite rational and that there is good reasoning behind it. They are not firing or refusing to hire people because they simply do not like old people. They are taking these actions because of the characteristics associated with older people. They feel these characteristics would be a threat to the economic status of their business. Their reasoning is as follows

It is true that not all mental abilities are affected to the same extent, and not all individuals slip at the same rate. An exhaustive study of age-related slippage, published last year in an issue of the journal Intelligence, showed that highly educated people with superior verbal skills retain those skills fairly well. Slippage is substantially greater with age, and the decrement is greatest in what psychologists call “fluid intelligence,” i.e., the ability to learn new tasks and see things in new ways. The ancient adage about old dogs and new tricks really has something to it (Seligman, 118).

This persistent group of people also come up with a few more compelling arguments. They believe that Congress enacted the ADEA because older people vote more. In other words, this gets Congress “in good” with the older generation. Also, they argue that Lyndon Johnson’s Department of Labor came up with studies that showed employers were irrational in preferring younger workers. How could Congress know what employers wanted better than the employer (Seligman, 118)?

Ways to Avoid a Lawsuit

Knowledge is power. The more the employer knows about the ins and outs of the Age Discrimination in Employment Act the better they will be able to protect themselves. Not only should the employer be familiar with the federal laws, but also the state laws. In many cases the state law is different, and more narrowly defined, than the federal law. Employers are not forced to hire older workers over younger workers. The younger applicant may be better qualified for the position. If this is the case, the employer has nothing to worry about, but if the employer chooses the younger employee simply because of age, he is asking for trouble (Flynn, 18).

In order to avoid a lawsuit, the hiring process should be carefully performed and monitored. The hiring staff should be thoroughly trained. When recruiting, employers should try and reach the widest array of applicants possible. They should be careful not to post job openings only in areas where the majority of the population is young, i.e., college campuses or “young” hangouts. If a company is using a recruiting agency, they must ensure that the agency is following fair employment practices. If the agency is in violation, the company can be held liable (Berluti, 8-, Raths, 84-85).

Job descriptions must be carefully monitored. Companies have to be careful not to use words that would attract only young applicants. They should avoid terms such as “young”, “recent college graduate” and “inexperienced”. Also, when describing the job, they must accurately portray the job requirements. If an advertisement states that the job requires a skill that is fairly new, when the job minimally requires this skill, that could be seen as age discrimination (Berluti, ).

During the interview process, an applicant should never be asked their age. The interviewer should also avoid asking questions that could be interpreted as age-related, i.e., “What year did you graduate?” The only “age” question that can be asked is whether the prospective employee is at least 18 years of age. The interviewer should give the job description accurately in order to avoid any misunderstand about exactly what is required. By doing this, the interviewer can evaluate the applicant on exactly the skills required, without any misunderstanding. The employer should conduct all interviews the same, asking all the same questions, to avoid any discrepancies between applicants. Documenting all the questions and answers is also a good precaution (Berluti, , Flynn, 17).

Aside from the hiring process, it is just as important to exercise caution in the firing process. Before terminating any employee, the supervisor should check with higher management to be sure the reasoning cannot, in any way, be seen as age discrimination. If the company is firing the older worker because their skills are outdated, they should first offer training. If training is not offered, the company will be seen as treating the older employee different and be at risk for a lawsuit. No matter what the reason for termination, the company needs to take extra precaution if the employee is in a protected class. They need to make sure that all complaints about the specific employee are documented as well as any conversations/meetings with the employee. It may seem like a lot of unnecessary work, but if a lawsuit arises it could be the evidence that predicts the outcome of the case. If the company hears that they may be at the receiving end of a lawsuit, they should seek legal counsel immediately (Berluti, 8-).

He alleges that his boss made a comment about his age saying “He must have come over on the Mayflower” (Seligman, 116). In 1, Reeves was awarded a total of $8,40 in damages and back pay. The employer appealed and won. The 5th U.S. Circuit Court of Appeals ruled that it was not clear age had anything to do with the termination. Roger Reeves then appealed to the Supreme Court. The Supreme Court agreed to hear the appeal based on the fact that various circuit courts were reaching different conclusions about necessary proof for an ADEA claim to be successful. As of this time, there has yet to be a final ruling on this case (Seligman, 116). Clearly, this case illustrates the confusion and complexity of ADEA claims.

The Case of Ida Morelli

This second case is the case that prompted the newly expanded portion of the Age Discrimination in Employment Act. Ida Morelli had been working for Cedel bank for ten years, when she was fired at the age of 54. Cedel is a Luxembourg bank with only one U.S. branch. Morelli brought suit against Cedel and lost. The judge told her that under ADEA, Cedel is not considered an “employer” because they have less than 0 employees in their U.S. branch. She appealed the case and the Second Circuit overturned the decision.

Judge Cudahy found no language in the ADEA mandating that foreign employees be excluded when determining which companies satisfy the 0-employee threshold. He also noted the reasons courts have found for the minimum-employee requirement in Title VII, the statute after which the ADEA was modeled, favor counting those foreign workers (Pines).

The Case of Joe Moore

This final case has yet to have a final ruling on it. This case involves Notre Dame University and their former football coach, Joe Moore. At the age of 65, Moore was fired as the offensive line football coach. He then filed suit against Notre Dame University alleging age discrimination. Moore alleges that Bob Davie, the head football coach, made several comments about his age, both to Moore and to others, prior to the termination. Davie agrees that he did make age-related comments, but disputes that age was the reason for the termination. Davie states that the termination was based on several conduct incidences, such as “roughing up” some of the players and encouraging under age drinking. Davie also contends that his age related comments were made out of respect and not mockery. A trial judge dismissed the claim saying that Moore failed to state cause of action. Moore is currently appealing the case to the 7th Circuit.

Conclusion

It is easy to see that ADEA claims are not cut and dry. There are many facets involved in both proving and disproving a case. The best advice available for a corporation to follow is “there is no such thing as being too careful.” It’s best to err on the side of caution. Corporations need to acquire as much knowledge about ADEA as possible, train their hiring staff, train their managers and supervisors, document everything and never make age-related comments or jokes. Intellectual property can be many things. It can be written, stored as data, drawn, and so forth. Any idea concocted by the human mind is intellectual property as is subject to exploitation. That ideas should be spread from one to another over the globe, for the moral and mutual instruction of man, and improvement of his condition, seems to have been peculiarly and benevolently designed by nature ... The only person that actually has permission to reproduce these materials is the creator. When an image or graphic is initially created, a date is attached to the file. When someone downloads the same image from a website and it is store on their hard disk the image will again be “re-created” on their hard disk with a new date. This date being the day they actually downloaded it. This date will obviously be later than the original creation date. The date appearing on the original file shows actual time of conception and therefore is a form of copyright and renders the original file protected. This is can be considered the “poor mans copyright” relative to the Internet community. The original copyright involves mailing an original document to ones self. The postmark is proof of conception in this case. However, this proof does not render an individual capable of claiming any monetary reimbursement should the copyrighted material be stolen and then used for profit. However, if the information contained in the mailed envelope is protected by a pending copyright and has been submitted for approval the violator is liable financially to the original creator/owner of the information. This type of “date protection” protection can be applied to any written document.

Information that can be copied and is not protected by copyright is considered to be in the “public domain”. These items are definitive of exactly when information passes into the public domain and becomes unprotected.

Copyright is the bottom line as far as protecting intellectual property is concerned, but just because the material has been copyrighted, does not mean it is completely safe. This procedure ensures that the copyright will then be recognized by anyone from any country as well as establishing it as public record. If this record is filed within five years of the original publication of the document, journal, song, etc., this registration provides further evidence that the copyright is indeed valid. However intangible it may seem, intellectual property is an asset and should thus be protected. Ownership of intellectual property is a powerful tool.
